Abstract

The procedural status of teachers and psychologists is not clearly stated in the criminal procedure legislation of the Russian Federation, hence there is a lively debate among scholars about the scope of their procedural powers and involvement. This gap leads to variations in the investigative practice involving teachers or psychologists in the interrogation of a juvenile suspect or defendant, thus undermining their active participation in pre-trial proceedings. The author analyzed the existing rules of criminal procedure concerning the participation of teachers and psychologists in pre-trial juvenile proceedings. Separate consideration, in view of the ongoing debate, is given to the relationship between aims and objectives of involving teachers, psychologists and experts in pre-trial proceedings. Having analyzed the legislation and the views of other scholars, the author came to the conclusion that these are separate subjects, whose procedural status needs to be determined by the law. To ensure active involvement of teachers and psychologists in criminal proceedings we need to consider some other issues as well. In particular, given the fact that the law allows the investigator to involve either a teacher of a psychologist in the interrogation of a minor, the article looks at the typical situations and circumstances, such as the minor’s personality, which determine the choice. Moreover, to avoid their nominal participation, we have to consider the question of involving specific teachers and psychologists. In addition, the author suggests her own opinion on the debated aspects.
