Abstract

The right to a fair trial is an effective guarantee of rights and freedoms protected by the European Court of Human Rights. The widespread use of the right is determined by its being stated in the European Convention on Human Rights and Fundamental Freedoms, namely in Article 6. The impartiality of the court is fn important condition for the fairness of the trial, which serves for an effective judicial remedy. The right to a fair trial requires equal opportunities to every person involved in the process, which does not amount to a formal procedural equality. The right in question is based on the balance of interests of the parties, taking into account the features of a particular case, the evidence provided and the possibility of challenging the decision made.The effectiveness of the right cannot be reached without understanding the category of fairness. The author comes to the conclusion that in Russia the right to a fair trial is not laid down in law explicitly, but it is being used as a legal tradition.
